Legal notice
The system enables users in public administration to:
"The file sender" can be a civil servant or an information system under the management of a public administration institution and must be previously registered in the security scheme and approved by the administrator of the application at MJU based on the request. Before confirming the registration, the administrator of the application can request additional explanations and in exceptional cases (if it is possible to reasonably assume that the user could pose a risk to the security or throughput of the system) can also refuse the registration. The sender must have a valid qualified online digital certificate and access to the HKOM network. If he wants to receive the password via SMS, he must also enter his mobile number. The functionality of SENDING files is generally not accessible outside the HKOM network (except by invitation). Each file sender has 20 GB of space available in the system, which can be adjusted accordingly if necessary and by prior agreement with the system administrator.
"The file recipient" can also be located outside the HKOM network and does not need a digital certificate and does not need to register, any valid e-mail address and mobile phone are sufficient (if the sender sends a password via SMS). The recipient receives a URL address by e-mail, where the sent files are waiting for him. If the sender has protected the files with a password, the recipient receives this password via SMS message or as a separate message by e-mail.
"Invite to send file" is the person to whom the registered user of the SOVD application sends an electronic invitation. The invitee can also be located outside the HKOM network, together with the invitation he receives a password and a link through which he can upload files to the system. When the files are uploaded, the registered user who sent the invitation is notified.
The Ministry of Public Administration as "service provider", administrator of the application or a technical intermediary, within its capabilities, ensures the stability and availability of the application, which serves as a technical tool for transferring files from the "sender" to the "receiver". The tool is not intended to store files. The service provider will make efforts for reliable 24x7 availability of the service, but is not responsible for any damage that the sender or recipient may suffer in the event of possible outages, disruptions or other problems in the operation or use of the tool.
The sender is fully responsible for the content of the uploaded file, who must fully comply with applicable legislation and applicable requirements regarding information security (respect copyright and not distribute copyrighted content, trade secrets or classified documents, chain letters or other content , which are not related to the work processes of the institution to which the sender belongs). The service provider does not have the possibility to view the contents of the files, as they are stored in encrypted form.
The anti-virus scan of the file, which the system performs for each deposited file, represents only a rough check and serves only as an orientation, and in no case can replace the existence of basic security measures at the sender and at the recipient of the files. The sender and receiver of the files are responsible for preventing the spread of malware, and the service provider cannot be held responsible under any circumstances.
The system may only be used in accordance with the published purpose and instructions, use contrary to the purpose and instructions is prohibited. In particular, all attacks on the system, the search for and exploitation of its potential vulnerabilities and shortcomings, and attempts to break into the contents of files and user privacy are prohibited. The service provider reserves the right to deny further use of the system to users who violate the rules of use.
Users can use the application in such a form as it is published at the time of use. The service provider reserves the right to improve the application both functionally and in design and technical terms and will try to ensure, to the greatest extent possible, that the existing functionality remains unchanged and any detected errors and deficiencies are corrected on an ongoing basis.
The service provider also reserves the right to improve the terms of use with the aim of clarifying responsibility and more transparent and efficient use of the system, in the interest of users and the service provider.
Any disputes between the service provider and its users will be resolved amicably by the parties. In the event that this is not possible, disputes are resolved by the competent court in Ljubljana.
